Do I need a building permit to replace my roof in Newton?

Yes. A full roof replacement is permitted work through Newton Inspectional Services, and so is any job that replaces more than a quarter of the roof area or touches structure. Small repairs and a pipe boot swap generally are not.

We pull the permit under our own license on every job that needs one, and there is a specific reason for that: under 201 CMR 14.21 the state's Guaranty Fund will not pay a homeowner who secured their own building permit for the disputed work.

What is the difference between HIC registration and a Construction Supervisor License?

They are two different credentials from two different agencies. Home Improvement Contractor registration comes from the Office of Consumer Affairs and Business Regulation under Chapter 142A and governs the business relationship: written contracts, deposits, advertising, the Guaranty Fund. The Construction Supervisor License comes from the Division of Occupational Licensure under 780 CMR and governs who may supervise the physical work and sign a permit. A roofer needs both. Ask for both numbers.

Can a roofer replace rotted sheathing under their roofing license?

Only up to a point. Table 110.R5.1 of 780 CMR authorizes a specialty roof covering supervisor to handle roof covering plus repair and replacement of twenty-five percent of sheathing and twenty-five percent of sistering roof rafters. Beyond that the job needs an unrestricted Construction Supervisor or a one- and two-family dwellings license holder. On Newton's pre-1930 stock that line gets crossed often, which is why we probe the deck before quoting.

How many layers of roofing can I have in Newton?

Two. 780 CMR R907.3 does not permit more than two layers of any roof covering, so if you already have two, a full tear-off is a code requirement rather than a sales pitch. We count layers at the rake and at every penetration during the inspection and tell you what is up there. A contractor offering to shingle over an existing two layers is proposing to violate the building code, which is a prohibited act under Chapter 142A section 17.

Why do you keep talking about ice barrier at the eaves?

Because Newton eaves are cold and the third floors above them usually are not. Ice barrier has to run from the roof edge to a point at least two feet inside the exterior wall line, and on the wide eaves and low-pitch dormers common here that means more than a single course. It is also only half the answer.

If your house dams every February, the real fix is air sealing at the ceiling plane. We say so even though that is not roofing work and not our invoice.

What is the Guaranty Fund and does it cover storm damage?

No, it covers neither storm damage nor anything a homeowner's policy handles. The Residential Contractor's Guaranty Fund pays an owner who holds a court judgment or arbitration award against a registered contractor and cannot collect it. Under 201 CMR 14.21 the cap is twenty-five thousand dollars or actual loss, whichever is less, it excludes attorney's fees, costs and interest, and it pays nothing if the contractor was unregistered when you signed.
